All property owners have a legal duty to ensure their premises are safe so that visitors are not injured.
Premises liability arises when a residential or commercial property owner fails to exercise reasonable care in correcting or warning visitors of hazardous/dangerous conditions on the property.
Everyday, someone is injured as a result of a hazardous condition on someone else’s property. In most instances, the injured party is able to quickly recover from minor aches and pains and maybe an embarrassing moment. However, some falls result in more serious injuries that require extensive medical treatment, time off from work, long lasting physical pain and emotional suffering.
